    You have to petition the federal courts and show that a judgment was awarded to you.

    This is both expensive and time-consuming, and if the tenant gets his refund before the federal court issues the garnishment order to the IRS, the IRS will NOT take the refund back.

    Because of these constraints, it is probably a waste of time to go after the tax refund.
