My son is 8 years old and we live in Missouri. I was never married to his dad and originally he was not on the birth certificate. When my son was 3 I files for child support and he signed that he was the father and was ordered to pay support. He has recently been in and out of prison. He is $5000 behind on his child support and he wants to give up his rights. I am not willing to let him sign them away unless he takes me to court because even though he wants nothing to do with our son he still needs to help me support him. I am wanting to take my son on a vacation and he wants to go on a cruise, but I am unable to get a passport without his fathers signature unless I can get sole custody. Is it possible to have him sign something and have it notorized and then file it with the court? If so how would it have to read? I don't want to spend our savings on an attorney if its avoidable.
