Can I move with my child 2 hours away from my divorced husband?
I live in NC with my 9 year old child in the family home. My separated husband decided he didn't want to be a family man or be married anymore. He wants to find his happiness. He bought a house and a 2 seater sports car and goes out with buddies and has even been hanging out with a separated woman. He left Halloween of 2010 and it is now January of 2011. He talks a big talk about how our child is his world but when he has her there is little quality time spent together. I have been a stay at home mom for 9 years out of the 12 years we have been married so he knows I cannot afford to keep the family home. I am also struggling to find a job in this bad economy, especially since there are hundreds of more qualified applicants looking for work, too. Here's the problem: I moved here with my husband(we were not married at the time) and left all of my family. I am from CA. I want to move home so I will have support. I have no support here. But, my husband says no way. He says I just have to suck it up and deal with it. And the courts will probably rule in his favor because of the distance. Because of his constant harassment I need now to just get out of the area for some peace. So I'm wondering if the courts would allow me to move 2 hours away to our capital city if I could secure a job there.

What does ( if you have one) court order say.

Most only require that you can not move out of state, but they can be more restrictive. I have seen them where one party can only move no more than 15 miles from the other.
** In Atlanta GA that could be a hour at times.
