    ITIN for examption
    Good evening ,
    My name is Simplice .I am in the Military and stationed at Ft. Bliss ,Texas.My wife and my 06 children are in Africa w/o ssn. They stay with my wife who has ITIN. We will file married and joint .Please, how can we claim our kids ?

    Simplice:

    Assuming you are a U.S. resident, you can definitely file jointly with your wife, regardless of her physical location.

    However, to claim your children, they must either be U.S. citizens OR be physically located within the border of the United States for at least ONE day in 2010 in order for you to claim them. Since they require ITINs, I assume they are NOT U.S. citizens.
