Diversion Question...
Hello everyone,
I have been searching for an exact answer and have found a lot of information regarding my current situation. I was hoping someone could shed a more light on the situation as I am in hopes of finding out a more precise answer.
I was admitted into the diversion program almost 3 years ago and have just been hired to work for a bank. Soon I will have to fill out administrative paperwork and am wondering if I will be denied the offered job once/if they see my past. I have recently graduated University and the incident that got me into the diversion program was most certainly the dumbest thing I have ever done ("hooked up" a friend at a retail store).
Any help in this matter would be a very big help and would give me a TON more peace of mind.

Hello T:
The idea of the diversion program is to divert people from the regular criminal process. If you completed it successfully, your record should have been expunged.
I say SHOULD. That doesn't mean it did.

It will most likely not show up on a regular police back ground check. ( except to law enforcement positions.
But?? And a big but, that is the official police background search. But there are 100's or more background search firms, that have records and are not under the laws that require files to be sealed or explunged or closed. So IF, they use one of those firms, and IF, that firm found and saved your information when arrested, Then yes it will show up.
And after that it also depends on how close a background search they do. When I took one job they had people go in person to talk to people I knew and more.

I appreciate the quick responses guys... I'm worried because I have read about ONE person in my similar situation that got denied a bank position because of his past diversion program... This however, was a person living in the US - I live in Canada and am hoping the outcome is different... Hopefully someone in Ontario can shed some light if they have gone through a similar situation.

Same answer, it will not show up if they get the background search done from the local police or official government background search, but as in the US there are private companies that may have it available

Completely agree. Diversion really helps - I am basically scared $*@#less about anything law related... definitely lesson learned.
