Are any Michigan sex offender felonies eligible for expungement?
My son is an alcoholic. One day while inebriated he used an aquaintences computer to look at pornography. In his drunken stupor he forgot to log off. It was reported to the police and they confiscated my sons computer. They discovered that some of the pornography saved on his computer was classified as child pornography. The judge convicted him of possession of child pornography as well as looking at pornography on the internet. I feel that was done (conviction of 2 felonies) so his crime wouldn't be eligible for expungement.

Stiff penalty with severe consequences of being on sex offender registry for 25 years as well as difficulty in finding a job with felony record. Actual sentence did not result in prison term but rather an alternative lock down and training faciity for 3 months. He was sentenced to be on probation for 5 years.

Why could he not look at regular pornography, it is not illegal, people do it very day, there are companies that produce it legally and more. So something is not right with your story, since he can not be convicted of watching regular pornography unless he was already a sex offender and ordered not to watch.

It may be that you have misquoted the law he was charged with, simply watching (adult) pornographic material is not generally a crime. As Fr chuck stated it could be a violation of probation. I would be surprised if a crime subject to SOR would be eligible for expungement before the 25 year term anyway, wouldn't make a lot of sense to have someone on the SOR and reporting for a crime that has been expunged. Though that's just opinion, check with an attorney in the area.

I am reading "The judge convicted him of possesion of child pornography as well as looking at pornography on the internet" to mean he was looking at CHILD pornography on the Internet.
