Theft Under 5000 in Canada at Winners and Court Fights
I stole a pair of gloves for 14 dollars from Winners.
The cops gave me a 65 dollar ticket for that.
Winners said they are mailing me charges for theft within 6 to 8 weeks.
I am also not ever allowed in any Winners across Canada.
    My questions are the following.
    (1) How will they know I am in Winners, there are many people shopping and how will they know me?
    (2) Can I take the $60.00 ticket to court?
    (3) Can I fight the Winners charges in court?

    Thanks

    Hello m:

    (1) Facial recognition software. (2) YES. (3) Just don't pay and let THEM sue you, IF they're going to.

    (1) They may not be able to tell, but if you are caught you can be prosecuted further. But there is software that can catch you.
    (2) Of course you can fight any ticket. But, I would suspect they either have eye witnesses or video to show you are guilty.
    (3) There is Canadian case law that allows them to charge you a fine for shoplifting. So its unlikely you will win such a fight.

This is my first offence. I have been caught doing refunds for cash and gift cards at Sears. The amount as of right now is around $4000. I was wondering what type of punishment I might receive.
