    How and when to file for an extension to evict?
    I am a tenant who is living in an apartment with my 3 year old daughter I refused to pay rent when I found out that my gas space heater in my bedroom was illegal in a bedroom so it could not be turned on. I have a letter from the health department that came in the mail after my time to appeal was up. So now I have no heat and am about to be evicted. I have went to court and now am wondering how and when to file for an extension. I live in Massachusetts. Is there anyone who can help me?

    Hello krystal:

    Something is funny here. Usually you'd be put out long before your appeal rights were up. Don't you have at least 30 days to appeal??

    By the way, IF the facts you present are true, you lost and can't get back into court. There is no such thing as an extension.

    You present your reason and evidence at the eviction hearing. In some areas you would have been required to put the rent money into a escrow account to pay the landlord once the problem is fixed.

    You will also need evidence where you informed the landlord that there was a problem,

    If they already had the eviction hearing at the courthouse, you would have to try to file a stay with the court, which will want to know why you did not appear in court on the day of the original hearing.
