    Can homeowner turn off utilities to evict roommate?
    There is a deadbeat roommate barricaded in a room within my house. Have given a Notice to Quit noting Hazardous Conditions and Damage to Property. Soon I will serve eviction papers. This is my house. I live here. There is no lease. This person has damaged my property, is barricaded in a room with debri nearly up to the ceiling! Can I simply turn off the utilities, in my name, at my house, when I serve the eviction notice this Thursday? State of Michigan-

    No, you cannot turn off the utilities. That is considered a constructive eviction and is illegal. You could be subject to extensive $$$ damages. All you can do is follow through with the legal eviction.

    When you do go to court for the eviction hearing by all means get an Order of Removal signed by the Judge in addition to the Order of Possession. This Order will enable the police to formally and physically, if necessary, remove this person from your home. Without that piece of paper the cops cannot physically remove the person if they don't want to leave. Small technicality but if the person barricaded in your home knows about this particular Order he can simply refuse to leave and the cops legally cannot physically force him out of the home.

    No you could face seroius law suit for turning off utilities. So get the eviction going
