    Will my tax debt that is over 10 yrs old be taken from disability money just awarded?
    I have just won my disability claim for ssi snd ssdi but have not been told the amount it will be yet. In 1996 I was audited by the IRS and in turn audited 5 yrs prior over the next few months. I have never paid the tax they claimed I owed and never got a lawyer to fight it. I was injured on the job in 2002 and haven't worked a job in the past 10 yrs that I made enough to file taxes on. Will the past debt being over 10 yrs old be looked at as uncollectable because of the 10 yr statute of limitations or can I expect them to take all my money both the lump sum and any additional for late fees and fines from my disability ? I do have a bank account now which Ive had for about a year and have not received anything regarding my past debt from the IRS. I hae also worked a couple of small pt jobs that did not amount to enough file on in the past couple of years and they never contacted me. Could it be they have writted the old debt off? Please help me know what to expect.

    Hello v:

    The statute of limitations SHOULD bar them from collecting... But, until it happens, there isn't any absolute answer for you. I don't trust the government to DO what it says it will do. Do you?

    By law, the IRS has the authority to collect outstanding federal taxes for ten years from the date your liability is due.
    Certain things can extend the SOL, such as being placed in non-collectible status, voluntarily extending the SOL or filing an Offer in Compromise. IRS may have placed your debt in non-collectable status so that the statue of limitation exceeds 10 years.

    So how can I find out without opening a can of worms. I don't owe that much 200 that now is probably tens of thousands. In the 90's I had a bank acct seized Today Ive had one for over a year and had no contact from IRS What should I expect.

    If the IRS has not contacted you after you having a bank account, more than likely they have written off your account and (probably) your SSDI will not be touched.
