    If I take over payments of a another,am I required to pay for their returned check?
    My husbands' ex-wife gave up possession of the moble home they had together.She wrote a letter stating that she was willing to give it back to him because she was unable to pay.With that being said.The company she was buying the home from agreed to us moving in as long as we paid $513.00 to get it current.The entire amount was paid in June and they said that we were current.Now they are saying that the $513.00 went towards a bounced check written by her.Now are we responsible for her bounced check or can we claim that we're current with our payments and that they should go after her for her bounced check?

    Who's name is on the mortgage? It does not matter who lives where or what you agreed to with her, its all about how the mortgage is written. If her check bounced then the account was a month behind and your payment brought it up to date or are they saying you need to make next months payment now?

    When we made the payment they didn't tell us it was a bounced check that we were paying for.Now they say we're a month behind.

    If your husband is the mortgagee then he is responsible for everything including the bounced check. Had his ex not ever paid anything he'd have to pay every payment. The ex was never responsible for payments if your husband is on the mortgage by himself. Was there a divorce decree than covered the home and who would live there and make payments?

    Yes.She was required to make the payments as a renter to the company.

    What company are you talking about? So you are saying the decree demand she make payments but the mortgage was left in your husbands name anyway.

    Most divorce decrees spell it out further by saying the ex can live in the home as long as she makes payments. If she stops paying she must leave which appears to have happened. Hubby is on the hook for all past, present and future payments but its his home and he can live in it or sell it.
