    NYS Child Support
    My ex and I have joint custody of our children. My ex pays child support. He sees them on his days off which vary from week to week. He works currently from 3-11pm which doesn't allow him to see the kids as much as he would like. If he changes to days, and decides he would like to have the kids on a split basis, how does that affect the child support he currently pays. Will the amount change?

    I've seen decisions go both ways - one argument is that you have (pretty much) the same living expenses whether the children are there or not (utilities, insurance, rent). The other argument is that he should not have to pay full support when, in fact, he is supporting the children (live and in person) half the time.

    It will be at the Court's descretion - and I wouldn't do anything without a Court order.
