Noise involving a child
My mother and I live in a one bedroom apt for 15 years in the same building. Since February we have been traumatized by a new tenant's child above us making noise (from his tricycle to hammering w/toys and jumping) from 10:30pm until 2 am every night. In the beginning we tried to speak w/the parents but in the middle of the year they started making more noise after knowing that we wrote a written complaint against them. The management told us that the tenants have carpet but the super and police said that they don't. Recently, after we complained (not having sleep for 2 weeks) to the tenants upstairs, they started yelling at us and called the cops. The cops told us to not go upstairs and go through management. I just spoke to management and they told me that they CAN NOT help us because there is a child involved and WE (the victim) may get evicted. Can you please help us??

Most areas have a quiet time ordinance that requires noise levels be kept down during overnight hours (generally 10-11pm to 6am). Check with your local government to check what they are. If they violate those laws, call the police and keep calling them every time. I don't know why having a child protects them. But without knowing your area (ANY question of law needs to include your general locale as laws vary) we can't check to see. Have management cite any statute that supports their claim. |
