    How can I get my husband out of my house and life without any money?
    We have been married for 12 years and he has repeatedly moved out ; the last time he was gone for 2 & 1/2 years and was kicked out of two different pay by week motels. His son, who I have helped raised since he was 5, came back to leave with me after 5 or 6 months being gone with his dad. So when Don was kicked out of the last motel 4 days before Christmas, I told him he could stay through the holidays and then he was suppose to move in with some friends. Anyway after Christmas, he said their place wouldn't be ready for another couple weeks; each time he would come up with another excuss until before I knew it he had been back for months. Now he says he going to milk it until I get a lawyer and have him put out. Unfortunately, I am not working at this time because I have to take care of my mother and don't have any money for a lawyer and he knows it. He drinks every night makes pretty good money and doesn't help pay anything. He wants to get drunk every night and then start on my daughter by constantly criticizes her and talking about her loud enough where she hears. And when we get into it over money or anything else he wants to blame her. A few nights a week we get a break until about 5 or 6 in the morning because he goes out and runs the bars. Please help me find a way to put him out of the home I paid for before I met him and that I signed over to my mother a few years back. Not only is he emotionally abusive he has been physically abusive as well.

    Next time he is drunk, call the police and throw him out of the house. What have you been waiting for? You paid for the home right? And he doesn't have his name on the papers right? So you have every right to call te police and get him out, even if he is not drunk or not being abusive.

    Just be strong and best of luck.

    File for restraining order.It always work for women.

    This is very wrong advice - we take great pride in our answers on the legal threads. Many of us are educated in the law, practice law, do great research, have experience.

    Your advice could get the OP in some serious legal trouble. The OP certainly can call the Police if the husband is abusive and then use that info to get a restraining order. This does NOT give her the right to "throw him out."

    Depending on your state law(s), the house may be considered marital property. You stated that you signed it over to your mother a few years ago - again, depending on your state, your husband may be entitled to half of the profit of the "sale." On the other hand, he may have to pay you alimony due to him working and you not - all depends on the jurisdiction and the circumstances.

    My greater concern is that the title of this thread is "how can I get my husband out of my house and life without any money," not "My husband is an abusive alcoholic, I need a divorce."

    If you can't hire an attorney, then file for divorce and appear pro se(represent yourself). Not every divorce needs attorneys. However, if your husband obtains legal representation, I certainly wouldn't go up against him by yourself.

    I don't know why your husband blames your daughter for your financial issues and honestly, the court isn't going to care if he blames her, you, or the Easter Bunny.

    Do you have any documentation of the physical abuse - photographs, witnesses, police reports?

    You need to get a job and start working so you can pay your own bills when he is gone
