    Does the non custodial parent have visitation with the children? Will the move interfere with that visitation?

    If the children's safety is at serious peril, report them to children services at once.

    If it is a custody issue you will need to get a child custody agreement that does not allow other parent to move away

    They do not want to move and he will be taking them out of their schools mid year, away from all family, and into a house that will have 6 kids and 2 adults. He has met this woman online and wants to be with her with no regard to the kids

    How do you get an agreement like that? See the kids are wanting to live with me and I am filing for custody at the first of the year and he knows this so he is trying to run.

    Yes, the non custodial parent will no longer be able to show up any day and visit between weekends, the children are very upset about the move

    So let me get this straight: you want to stop your ex from moving away and doing what he wants with his life, yet you're not going to file for custody until the first of the year. Is that correct?

    What are your grounds for requesting the placement change? The courts are going to want proof that the children will benefit from a change in their habitat and lifestyle.

    You mentioned the children want to live with you - how old are they? I'm sure you're already aware but the children simply saying they want to live with you isn't grounds for a change; a judge and/or guardian ad litem will listen to them but dependent on your state laws, they are not necessarily required to listen to the children's "desires." I know plenty of people who have lost custody even though their kids told the judge that they wanted to live with that particular parent.

    The ONLY reason I do not have custody is he left me homeless, no car no job... I had been a stay at home mom for 5yrs, we lived out of state and I had no friends or family to lean on to even get a job, no babysitter.

    Nor does he get them medical attention, our youngest sons bowels would have rupured if on my visit I hadn't noticed a bulge in his stomach, I had to make him take our son to the Dr. He is neglecting them and it has gotten worse since his new girlfriend whom has 3 kids of her own, 2 girls that run around with no shirts, and a boy whom they make my youngest son bathe with.

    It is a horrible situation! They are ONLY there because I let them to prevent them from being homeless. The reason I was waiting until the first of the year is so I would have enough money to support them, that seems to be all that people look at!! I have the LOVE, SUPPORT, ENCOURAGEMENT, and NURTURING, and they can talk to me without being told " tough deal with it"... My kids are dying inside while with him!!
