    Can he take my car from me?
    I recently traded my car in for a more expensive one. The previous one was mine and the title was in my name. All paid off, I sold it to the dealership and put the credit towards my new car, I still have $10,000 more to pay. My Mom put it in her name since I don't have hardly any credit. The deal was she puts it in her name and I make the payments. I moved out yesterday and she wants to take my car and keep it now. Can she legally take my car if its in her name even though I owned the last car and put the credit towards it? Please help!

    Yes, she can legally take "your" car if it's in her name. It's her car to continue to pay on or to trade in or to sell. Your previous car and your ownership of it has nothing to do with the newer, more expensive car.

    Why can 't you make the payments?

    She can take the car because it's in her name. Legally it's HER car.

    The point is she is not taking YOUR car. In the eyes of the law, the title in her name, therefore its her car.

    Why does your mom want the vehicle? Have you missed or been late on any of the payments?

    Legally, the vehicle is hers. You might have a claim against her for the money you paid towards it, but the car is still hers.

    I don't suppose you and your mother put anything in writing regarding this agreement of "her vehicle, your money"?

    I just got the car and moved to the town over as planned. She is upset I can't stay their and help her out at home. She said she wants the car and that its in her name. We didn't write any agreement. I haven't missed a payment. I guess I will have to let her take the car. Thank you for clearing things up for me.

    If it goes that far that she's willing to leave her own child without a vehicle, I'd take her to court for the money you paid into the car.
