    Deed
    My 92 year old brother lives in TN. He Deeded the property to his step son and his spouse. The step son passed away and his spouse moved out. There was an agreement drawn up by an attorney that stated that they were to live there and care for him as long as he lived. Can he break the deed since she breached the contract?

    If the agreement for his care stated that the transfer of the house was conditioned on caring for him then he could sue his spouse to have the deed rescinded and probably win. If the agreement didn't say anything about care being a condition of the transfer then he could sue but he probably would win a money judgment rather than having the deed rescinded.
