Can North Carolina garnish my wage for Idaho judgement?
I am now a resident of Idaho.. I filed personal bk and had it discharged in march.. one creditor is trying to get his debt(bank mortgage shortfall) taken out of my bk and then try to attach my income as we have no assets.. we are 62 years old.. We were thinking of moving to North Carolina to be with our daughter and get a job there.. Can we be garnished in n.c. For a judgement in Idaho? Help us please

I don't understand why this creditor's claim wasn't addressed by your Bankruptcy Petition.

At any rate, yes, a Judgment can be transferred and enforced in another State.

    Your age does not matter.

I am a little puzzled, If you filed bk
Did this creditor appear when you went to court to contest it? And if your bk was discharged in march why have you not had your attorney address this issue for you? As Judy said a judgement will follow you and it will vary from state to state as to how it is carried out.some states allow wage garnishment and some don't. But most all states will allow for a bank levy to satisfy a judgement.

    What type of debt ?

If it was discharged in bankrutpcy, give them the bankruptcy court number and they can not do anything.

If there were not included, why ?

Moving to North Carolina [ 2 Answers ]

My wife and I are considering moving to NC. We're looking for: affordable housing (200-300K), a small community (50,000 - 100,000 pop.) close to a larger city (we like city life but don't want to live right in it) and somewhat close to the water, say 2 hours. NC seems appealing because of the...
