    What can happen on post-judgement credit card debt
    A collection agency is harassing my 87 year-old mother regarding a credit card debt that she did not incur. Someone stole her information and took a credit card out in my mom's name about 12 years ago. Now after not hearing from the collection agency in more than 7 years, after they filed a judgemnt and after the SOL, they are threatening her with a lawsuit. The stress is causing her health problems. What can we do??

    1. a judgement is a law suit, what happened in that court action ?

    2. did she file a ID theft report with the police.
    3. did she file theft charges with the police on the credit card debt ?
    4. did she dispute the debt within the 60 days after receiving notice of it ?

    1. The only documentation she has from 2004 is interrogatories (request for documents). She never went to court, nor was she ever subpoeaned (sp). Now, however, the collection agency is saying they will be sending "post-judgement" interrogatories. The court is in Texas and she is in Pennsylvania.

    2. She did not learn of the situation until 4 years after it occurred. She believes it may have been a family member who is now deceased. Therefore, she did not file anything with police.

    3 & 4. As soon as she learned of the problem, she sought counsel, and the attorney sent a letter to the collection agency.
