    Who is responsible for maintaining a drainage easement that runs through property
    There is a drainage easement that runs through the middle of my property (OHIO). This easement has never been cleaned out and it is completely overgrown. In fact, when it rains (just a normal rain), the 40' drainage easement will fill completely. This has been a problem since we started building our house. Mr. A had come out to the property and stated that it was overgrown and unacceptable. He also stated that he would not take the allotment off the developer's hands (Mr.D) until the drainage easement was taken care of. Some time had passed and I spoke again with Mr. A. He stated that Mr. D would not take care of the problem and the city did not have the money to take care of the drainage easement. So, during a city council meeting, I presented my case and Mr. A said that he would look into it. Who is responsible?

    I think it is a BIG mistake to post names - a VERY BIG mistake.

    What does the easment say about maintenance? If it is silent in my area it's the expense of the person who is using the land but doesn't own it. HOWEVER, rather than argue this I'd pay to get it cleared and THEN address it with the other party.
