If I am behind on my child support payments, can the state of Florida attach a home (second home) that my wife and I own together, jointly? It is not held as tenancy by the entireties, because we (really she) purchased it before we got married. Also, would changing the way it is titled help protect it from a lien by the state?

Am I correct? You have two homes, one in Florida which you occupy presumably occupy seasonally and which is held jointly with your current wife, but you could not afford your Court-ordered child support payments and want to make sure your vacation home is not liened to pay your child support?

You would like to change the title in order to keep the property from being used to support your children?

I would consult with an Attorney. In NY any property transfer which appears an attempt to "beat the system" can be reversed.

I assume you don't have a Florida driver's license because that can be suspended or revoked, also.

Tax Refunds: IRS tax refunds can be intercepted to pay Florida child support payments.

Lottery Winnings: Florida Lottery winnings over $600 can be confiscated and used to pay child support payments.

Liens: The Florida Child Support Enforcement Agency can place a lien on property such as homes, land, cars, and boats owned by the non-custodial parent until the child support payments are made.

Levies: The non-custodial parent’s bank accounts can be garnish to make up for back child support payments."
