    My son is 15 and lves with his father, but wants to live with me. What do I do
    My son is 15 and lives in Georgia with his father. I live in Florida. His dad let him come down for a week to visit, and does not want to go back. I was not there in his life or his father and my son lived with his Aunt in Georgia, and 2 years ago the Aunt gave my son to his father. I have straighten my life out, and have been clean for 10 years. I want what is best for my son, and feel it is with me. His father does not work and sales drugs. This is not where he needs to be. How do I get custody of my son?

    You file for custody where custody was awarded - presumably in Georgia.

    If you file in Florida they will reject the application (because that is not his legal residence) and refer you to Georgia.

    If you keep him beyond what his father agreed with you will have additional legal problems.

    If he is at risk and you can PROVE it - not he said/she said - then that would be your grounds.

    On the other hand - if you've been clean for 10 years why didn't you try to get custody before now? That's what the Court is going to ask.

    Who has court ordered custody at this time? Your going to have to send him back if there are court orders and file in court to change it.

    I did not try till now, due to his aunt moved and changed her numbers. I had no address or anything to give the courts or a my lawyer at the time to get custody. THanks though cause I can prove it, and that to me is legal grounds has well. Thanks for

    This is is the kicker. His Aunt has papers not his dad. His Aunt said she does not want him anymore so she sent him to his dad. His dad will not give him to me. THanks for the answer to my question. I now am going to see a lawyer this am, and try eve
