This would be a Small Claims action in your Town/City.

For small claims do you have to file in the city in which it happened. Agassiz BC
I sold my pickup truck in Agassiz but now live in a different city. Where would I file it. Also what happens if the person does not show up in small claims court. Would I automatically win. Would they get a fine for not showing up? How much is it to file a claim in Agassiz?

Of course they wouldn't get fined. It's not a criminal case.

You file where the other person resides or does business.

If the other person doesn't appear, yes, you would get your judgment by default.

Call Agassiz and ask what the fee schedule is - it varies by the amount of the claim.

Where do you “file” your lawsuit?
You have a choice. You can “file” or start your lawsuit in the Small Claims Court registry that is either:

Nearest to where the person you are suing lives or has a business, or
Nearest to where the event happened that resulted in your claim.
    What is Small Claims Court?
So the fact that you have since moved really has no bearing on where you would file.

As another poster has said, yes you would win and they would not be fined for not showing up. Read the court rules to be sure.

Other information can be found here.

In British Columbia, the filing fee is $26 if the claim is less than or equal to $3,000. If it's more, it's $50. The maximum you can ask for is $25,000. There are other fees too. Details are here.

I have sponsored somebody to Canada lived with us for 17 months went back to the country brought back by somebody else stayed with the other person for a year. The sponsored person is put in the shelter and collecting welfare now we have to pay that back Government. We want this person to and leave with us for free but she is been brainwashed so badly that she only trying to abuse the system instead of working or taking help from us. We want to take her to court to stop her from collecting assistance.
