    W7 form
    I have filed 2009 tax return in April, 2010, with W-7 form to get ITIN no. for my wife. My wife came to US first time in 21 Jan 2010, though we got married in 21 Jan 2008. When my wife joined me on 21st Jan 2010 than only my employer asked me to submit W-4 form to IRS.
    Since my wife was outside US in 2009 I filled my federal written form 1040-EZ as "SINGLE". Unfortnely, my wife's ITIN application got rejected.

    Your wife's ITIN should NOT have been rejected. The fact that she was NOT in the U.S. is irrelevant as to whether you can file jointly or not; she could be on Mars for all it matters.

    Please email me at [email protected] with a PDF copy of the W-7 so I can evaluate it. It will then propose the next step, which will involve filing an amended return with a new W-7.
