Child Support by Non Biological Fathers
I am hoping you can help. Our son is 39 years old. He is divorced from a woman {edited} He was only married to her for 7 years. He is not the biological Father to her two children. The children's real Father was a dead beat Father and never held a job down. So, she did not collect child support from him.
Our son feels she married him because he was {edited} in the Marines. He retired in {edited}, 20 years in. He has a small pension, small disability which she gets a percentage of that was well.
She makes more money than our son does. He will be teaching (edited} soon . Teachers do not make that much money. He is paying $1700 per month for two children that are not his and the children do not want to visit him. They have their own life.
{Location edited} Since he feels she married him to eventually collect child support from him, because she wasn't getting it from the real Father, does he have a case to Un-Adopt the children?
From what we gather he seems to be afraid of her. When we met her while they were married she was very cold and distant and controlled him. Or, he let her control him.
Now, he is miserable because he doesn't have much money to live on. He knows he needs to go back to court to have the support decreased.
Is there such thing as un-adopting and does he have a case? I take it he has no proof that she married him, only to divorce him later for the support.
Sorry if I'm rambling too much! The children are 14 and 15.

No, most courts do not allow a person to un-adopt. Since he knew full well what he was getting into then he had his choice already. Since they are up in their years he won't be paying for too long.

Does anyone know if it's expensive to go back to court to reduce the child support payments?

Depends really. If he is paying though an agency then he may be able to use them to get a reduction. Also how long has it been since it was first decided and was he in his current situation. They don't like to adjust unless there is big changes then every 2 years. Also how much of his pension is she getting? Because if he is on SSD they children should already be getting something from it and it may count towards his child support.

I'll have to find out the answers to your questions. I know she is getting 1/4 of his disability... not sure about the pension.

Sorry, I am one of the moderators, we do not delete questions, you are warned if you read the FAQ that is obvious. Also you are not to use a screen name that they would know, I don't know how they would or could tell it was them, there are many people that may fit that.
But no we do not delete questions, they stay. I am sorry someone did not like what you posted, but to be honest, about 25 percent of the posts someone would not like their story being told.

When I first applied to this site, I clicked on the terms of use, but did not see any writing. I run sites, with edit buttons and delete. I think you should allow at least an edit button. Thanks for editing.

The reason you don't see an edit button is that you are new to the site. After posting a specific number of posts the edit button is activated.
