    What does the court say about moving out of state with your child if the reason is to
    My husband has a new job in Arkansas and I have a child from a previous relationship. The father of my son is very active in his life and we do have a current visitation order. What do I need to do to get permission to move with my son to Arkansas?

    For one thing if he is very active in your sons life you might consider a custody change. Let the father have the child and you move with your husband. IF that doesn't sound right to you the courts may tell you that exact thing. If the father fights the move that's how it most likely will end up. Why are you trying to disrupt the relationship between your child and his father?

    Well first, it is not "how to" it is really if you would even be able to. It is very very possible that the court will not allow you to move.

    But agreed, if the other parent is very active, the court may just allow them to have custody and give you fair visits that you can do from a distance.

    I agree with the other two. Being that he is very active the chance of you being able to move the child is slim none. You of course can move where ever you want but the child could have to stay. Would you be willing to give him custody in exchange for you to have visitation? The other thing to keep in mind is if you are allowed to move the child then any added visitation travel cost will fall on your shoulders.
