Foreclosure tenant no rental agrmnt, stopped paying, 15 day notice info needed.. HELP
Found out end of march the building I am a tenant in is going into foreclosure, my lease is up, I have no rental agreement.. 4/20 received a three day notice, but because there is no rental agrmt I believe they should have given 15 day notice? Instructions to landlrd I read on court clerk website say give 15 day notice for next rent due, I pay on first of month and is going to be past first of may by the time this notice is given, will they even be able to give this notice for the April rent ididnt pay, or since they're so late have to make it may? Or even June, since that will be "next rent due"??

First, I can't understand why anyone would ask a legal question without giving their general area. Laws vary by area so without knowing the area we can't give definitive answers.

If you have no rental agreement, then you are known as a periodic or month to month tenant. Notice for termination of lease for month to month tenants can vary from 15 days notice to one rental period depending on area.

The only way a 3-day notice is valid is if your rent was past due. If you paid for April. Then they can't do that.

Also, if this is a commercial apartment building, then they have to honor previous tenant arrangements. Did you EVER have a lease or rental agreement?

Finally, why do they want you out? Have they given a reason.

Sorry, Pasco county FL... I did not pay April because I told them I need to save for new place. I offered them 250 which is more thanv half of my rent, that I would give them MAy and June 1st, which if they agreed would consider It paid in ful for April, May and June, which would total almost two months rent saved that I would have for a new place if the property is foreclosed on. Since it will cost 250 to evict me and It is already the end of April, I assumed they would agree, but they just left the three day nottice. This may just be one last scare attempt befored they accept my offer, But who Knows
