Help getting a boyfriend out of my house
I have a boyfriend living with me that refuses to leave. He is not on the lease, gets no mail there & pays no bills. He is getting progressively worse with the drinking and verbal abuse.I hate to think about giving a 30 day notice. He could destroy anything out of anger in that time. Do you think that there is a way around it with the landlord's help. I
Would love to change the locks & alarm code. I am a nervous wreck right now at work
Because who know what he could be doing whil I'm away. I would never keep any of his things, I just want him to go. Can't afford a lawyer & anyway he isn't that bright legally.

Have the police remove him.. get a restraining order... change the locks and you phone numbers. Is mace allowed in your state?:confused:

The police won't be able to just remove him unless you have him evicted or get a restraining order, assuming he's considered a tenant there. That varies from place to place but its usually easy to be considered a tenant. And you'd better check with your landlord before changing the locks or anything. I don't know about your lease, but mine specifically says that I am not allowed to change locks. You might even need your landlord to evict him, I'm not entirely sure that you'll be able to. Hopefully one of our more knowledgeable members will be able to tell you for sure.
Like kat suggested though, if he's being abusive, you should get a restraining order. There's no reason you should live in fear. If he begins destroying things, making threats, carrying through with threats, anything violent, call the police, make a report, and get a restraining order.

Where are you? Tenent laws vary from place to place.
How long has he lived with you? Is it his legal address?

You can try calling the local police and asking them if they would be able to remove him, as things stand now. If not, then they may be able to tell you what you would need to do to get him removed.

Since he's not on the lease, he's not a legal tenant so he has no privilege to be in your apartment. Have his a** hauled out of there by the cops, then get the restraining order.
I don't think the cops would have a problem arresting a lazy, abusive drunk.

In a lot of places there doesn't even need to be a lease for someone to become a tenant. And even if there is a lease, the persons name doesn't always need to be on it to be considered a tenant. Laws vary from place to place though. We would be better able to help the OP if she would come back and tells us where she lives so we could help her determine what the laws are where she is.
But if he's being abusive, she could have him arrested and then they could take him away.

I live in Missouri. He has been here since July 2009. I don't know if it's
Considered his legal address. He gets no mail there. The lease does say
1 adult.

Is that address listed on his driver's license or voter's registration, or any other government paperwork? If not, then it's not his legal address. That should make it easier to get rid of him.

The address is not on his license or voter registration or anything else.

He's been there close to a year. He's a tenant. Therefore, there's only TWO ways you can get him out. You can evict him or get a restraining order against him. That'll get him out right away, but I don't know if you'd get it. From what you say, you're not in danger.
Otherwise you need to evict him. He's YOUR tenant. He's not your landlords tenant so the landlord can't evict him. You have to. We have copies of your states landlord tenant law on the real estate page on a sticky note. It usually involves giving him a 30 day written notice, and if he doesn't leave then, you file a court action.
