    F1 students and Educational credits ( help)
    Hello,

    I am F1 students and filed for educational credit (American Opportunity Credit) and got a refund.

    Now I am seeing some of my friends refunding. I went to some of the tax filing stores and they also said: F1 students are not supposed to get educational credits.

    Can anyone help me on these matters? Should I return or Not?

    It appears that you file resident return instead of nonresident tax return.
    On F1 you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to FICA taxes but you must pay federal and state income taxes. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents
