Bank lien
I discovered a levy on my business account. It appears a debtor company which is now dissolved had a similar name. What do I do now?

File a motoin in the court with the judgement to have your funds released.
They should have had more than a name, a Federal ID number, a social security number something

Find the court that authorized the levy and file a motion to remove it.

The company name is similar to another company who owes them. Our attorney will file a Motion on Monday. Our name may be similar but we have never done business with this collection attorney nor his clients. We have a different tax ID and none of our officers have ever been involved with this company. Somehow we have to resolve this situation ASAP b/f it escalates. Thanks

Sounds like a less than ethical collection company, but not uncommon, they do the same with people that have similar names

The lien was not signed by a judge. It was a blanket subpenoe to all banks within an area. The collections lawyer did not give the tax ID of the debtor company. The only tie is the name. The bank has asked them to produce the tax iD and a properly signed court order b/f any monies may be released. Meanwhile I have hired an attorney to take care of this matter. What happens next

If the lien was not authorized by a court order, then it should not have been recorded by the county clerk. Get a title search done to see if a lien has actually been recorded. Blanket subpoenas like that are not legal as far as I know.

I will definitely post an answer on Monday. When my attorney offered to fax them all the paperwork they demurred cause they are on shaky ground could be sued for malpractice.
