    Non resident or resident taxes
    I have been in the US on a J1 visa from July 2005 until March 2009.
    I understood that after 3 years I should file taxes as resident, but during 2009 I only lived 3 months in the US.
    What taxes should I file? If can do both ways which one is better for me?
    I have 2 children that are not US citizens, but my third was born in the US and is a US citizen.

    J-1 Researcher is exempt from residency for 2 years. For 2008, you were resident. Which return did you file in 2008? Your citizenship?

    For 2008 I filed non resident. My citizenship is Israeli.

    You would file as a non-resident for 2009 as well.
