    Debt judgement
    Hi, a credit card company that I owed, has sent me a notice to appear in court but my atty. Said he was going to do the negotiations for me. I offered to pay $4000.00, I owe them $17,000 + atty's fees total of $25,000. They insisted that they will not take it & will proceed in the judgement on me. I own a house but of course no equity. So, what is my recourse on this. Just let them proceed with the judgement? Can they garnish my wages? I sell real estate. How can I protect my wage from being garnished? Can I instead declare bancruptcy? Can I do it by myself with out involving my husband?

    What state are you in? The last thing you want is a judgement. A judgement will enable the creditor to garnish your wages,if your state allows and "levy" your bank accounts.Only you can decide if bk is right for you. You could file by yourself but depending on the laws in your state your husband may also be responsible for the debt Does he not know? How old is this debt and have you tried eariler{ other than the $ 4000 offer} to make payment arrangements?

    I'm in AZ. This debt is recent, I stopped paying them last year about June, when there was not much sales. This debt is only on my name. No I didn't try up to now.

    Yes I do believe they can garnish your wages. You also may want to discuss this with your broker ( assuming you are a agent working for a broker) to see if there is issues with your license for having unpaid debts and a judgement

    I know in the insurance industry it can effect your contracts with many companies.
