    Tenant Will Not Pay Or Leave
    I Have A 3br House Of Which I Live In One Room And Rent Out The Other 2 Rooms To Separate Tenants On A Weekly Lease. The Rent Is Due Every Friday. One Tenant Has Refused To Pay Me For 3 Weeks And I Wrote Him A 5 Day Eviction Notice And Now He Refuses To Leave For Another 30 Days. He Sd That He Will Not Pay The Balance Owed Or For The Next 30 Days. He Has Threatned Me As Well As Far As He Will Have Me Arrested For Harassment And Walks Around The House Banging Stuff As If He Is Trying To Tear Or Break Something? What Can I Do? He Says He Has Renter's Right's What About Me What Are My Rights? I Feel Like I Can't Even Go Home To My Own House.

    If he is in common areas and is threatening you, you can call the police on him.

    You should have done something after one week was not paid, not wait.

    What is your written agreement with them, ( you should have one)

    You will need ( and should have already) filed an official eviction notice, and then filed with the court to have them official evicted.

    They have no rights, other than to be evicted by the sherff office or court baliff, after one week late, is when you should have acted.

    ( now personally I would have just thrown them out if they threatened me, change the locks and the such) ** not legal but what I would have done.

    Check your state's Landlord-Tenant laws on eviction procedure. Be sure to look for whether there are special rules (or even a relaxing of them) for the case of his renting a room rather than an entire apartment or house.

    I Have A Written Weekly Lease For Him That States That He Must Vacate Within 7 Days Of Non Payment. I Had To Write A Notice To Him Giving Him Until Dec 06 Yes I Know I Should Have Had Him Out Sooner He Has A Pregnant Girlfriend Also Living There And I Was Trying To Work With Him On The Rent. I Live In Virginia And They Allow A Tenant 30 Days Notice For Eviction As Far As I Know And This Could Go On For 60 Days. Thanks For The Advice He Is Causing Grief For Me As Well As My Other Tenant
