    Am I Resident alien by first year choice?
    I worked as OPT from July 2008 through 2009. My employer applied for my H1b was approved on December 4, 2009. Do I file a resident tax?

    If you did not complete 5 years on F-1/OPT file nonresident tax return with Form 8843.
