    It depends on whether you are subject to INA section 212(e), 2-year home residency. Check your visa for any annotation, the DS-2019 and the FAM skills list as well as checking to see if there was any government funding. If all negative, and you have a way to get PR, you can file. I would advise to consult with an experienced immigration attorney,
