I am in Florida and am being forced to break my lease due to losing my job. I have lived in my apartment for over 2 years, so I am on my third one-year lease.

When I first moved in, I received a concession of the first month's rent free. I just read my original lease and it states that if I break the lease, I have to pay back concessions received "during the course of occupancy".

Will they really make me pay this? That concession was part of my first lease agreement with them, which has been satisfied long ago.

That should have been taken care of at the end of the first year, unless you received some concession for re-signing your lease.

But that is really the least of your real problems, esp in Florida, you can't ust break the lease, and they may and can require you to keep paying until they find a new renter ( and they are not even required to try in Florida)

So when you break it, where are you moving to ? Remember they can sue you for all the rent till they find someone to move in.

Thanks for your reply. It made no sense to me that I'd have to pay back a concession that was not granted during my current lease, but the wording of the lease made me wonder!

My lease does contain a clause allowing tenants to break their lease by "buying it out". When all is said and done I will end up paying about half of what I would have owed for the remainder of the lease. It's painful but I guess it could be worse :-P
