    violation of probation fines
    I've been on probation since 2003 for 2 charges in 2 different counties felony theft and felony drug the drug charge was transferred to the county I live in along with the theft charge, I received 5 yrs each charge,there running concurrent, 1 chrge I had a $6000 fine and the other was $2500 the judge that sentenced me on the 6000 fine orderd me 2 pay $30 a month being that I'm on disabillity now my probation off. Put in for and extension being that I haven't finished paying.I received that ext. I still made payments ,but now my time is up again and its been 7 yrs now my po is is fileing for a violation due 2 non payments of fines even though I' been making what payments I can my question is if the judge grants the violation will he issue warrant right then and there or will I get a court date 2 appear I live in New Jersey please respond asapp.

    You will end up waiting in jail for your probation violation hearing. It's not that easy to just send out a notice of hearing for a probation violation hearing and expect the probationer to show up.

    More than likely you will have to spend time waiting in jail for your hearing.

    Have you asked for another extension for the payments? You just might be able to get the second extension if you are current with your payments. Have you requested this of the Judge on your own?

    Also, have you proven to your PO that you have a fixed income that you are working off each month in which to pay your fines with?

    Hello t:

    If you've been making regular payments and you can show that they're reasonable, after this much time, I doubt they'll violate you. They didn't arrest you before they informed you that they're going to file a violation, so I doubt you'll spend any time in jail. The judge may extend your probation so that you'll be under supervision while you pay.

    It certainly wouldn't hurt to have lawyer represent you at the hearing.
