Took ex boyfriend to small claims, HELP
I took my ex boyfriend to small claims because he owes me $2,600. And I won, but I am having trouble getting the money. I tried to garnish his wages, he works with his grandfather, so they lied and said he is working part time. So I couldn't garnish. What do I do?? I want to know if I can take him to collections? How do I get the money? It's been like 2 years now and I am trying to get the money I loaned him.
(stupid mistake)
Please help,
Lacy

It should have matter he's only working part-time, serve them again, with the court order. If they fail to comply, take the grandfather to court for violation of a court order. An garnishment is a court order.

Yes it does not matter if he is only working one day, when served, they have no choice but to pay the percentage.
Find his bank accouts and try to get a attachment of his bank account.

You have run into the Catch-22 of getting a judgement against someone. Getting the judgement is only half the battle. The other half is collecting. YOU have to find any assets that can be attached if he refuses to pay.
You could turn the debt over to a collection agency, but they will take a percentage of whatever they collect.
I would go back to the court and ask them for a subpeona of the grandfather's payroll records. Then serve that at the same time you resubmit the garnishment order.

Great advice Scottgem, subpeona would do the job in this case.
