My niece refinanced a house in Florida four years ago, she received poor advice and signed an absurdly expensive mortgage on which the payments have gradually increased way beyond her means. She has stopped payments and the bank that currently holds the mortgage started eviction proceedings, but in the course of legal wrangling it turned out that the bank could not provide ANY papers of ownership. For well over a month, NO PAPERS - NONE. What might happen if the papers are never found?

First, there is no such thing as squatters rights. Second, you say she refinanced, so there was a previous mortgage. Has she gone to the county clerk's office to see who holds title to the property and what liens are there?

I'm not sure what you mean by "papers of ownership". Your niece owns the property, but the mortgage lenders have a lien on it, or should have.
