Do you lose your green card if your wife cheats on you
I got married to a Us Citizen and I got my green card through her. We were a couple since 2002 and got married back in April of 2009, now I found out she cheated on me and things got bad between us because of that. She has threaten me to divorce me so ill loose my green card. Is there such law that will protect me from losing it. But then again how will I prove she cheated on me?
Thanks a lot for your help

You will not lose your PR based on these facts. Since you were only married in April 2009, you must have your conditional resident card valid for two years, correct?

If so, then if you divorce, you only need to prove up that it was a real marriage, which should be easy as you have been together for 8 years. Gather documents to show cohabitation (living together as husband and wife) and co-mingling funds (sharing income and expenses) to include your 2009 tax returns filed jointly, bank accounts, utility bills, mortgage, pictures, drivers licence showing the marital address, correspondance addressed to both of you at the marital address, etc. if necessary, you can supplement with affidavits from family, friends, co-workers, neighbors, etc. You might even qualify under VAWA if the threats of deportation are part of a pattern of abuse and control.

You do not need to prove up her ifidelity. As soon as you are divorced, you can file to remove the condtions, form I-751, without having to wait for the 2 years. Consult with an experienced immigation attorney. Good luck.

    Thank you.
Yeah we have all that. Car insurance, bank statements, health insurance etc.. All going to the same address. The address we lived in. I am currently enlisted with the Marine Corps and they told me that even if she divorces me it would take about a year by then I will be through boot camp, and after been in for 6 months I can apply for citizenship but it will be really pushing the time because it will probably too late.
And yes the marriage is well was Bona Fide. We were together for a very long time and she just changed completely.
Thank you NYcityboy for your help.
