    F1 to H1b tax
    Hello,
    I'm from India. I did my MS in US from August 2006 to August 2008. I started work in November 2008. I was working on my F1-OPT. My H1B started on September 2009. Which all Tax forms should I fill for my 2009 tax return? Am I considered a resident or non-resident for tax purposes. Thank you all for your help.

    If you are single you have to file as nonresident. File form 1040NR. If you are married you can choose to file joint by doing first year choice election and file a dual status return with 1040NR as a statement and form 1040 as the main return form. See pub 519 for details

    Yes, if you are single file nonresident tax return and Form 8843.

    Thank you all for your help. But, is there any website that offers efile for 1040NR-EZ? Or can it be filed only by mail.

    Nonresident tax return can not be efiled. You must also attach from 8843 as you have OPT income. Your U.S. Tax Return: The U.S. Visas

    Hello everyone,
    Thank you all for the help and support. The 1040NR EZ form of 2009 is quite different from the 1040NR EZ 2008 form. Could you please let me know what I should enter the very last page for question J parts (c) and (d). Also in the 8843 form, should I fill "Part II" or "Part III" ? I graduated in 2008. In 2009 I was working on OPT till September for a different university not my university. Thank you all once again.
