The fact that you are not married to the mother has almost no bearing here. What you do is what you should have done when the child was first born. You go to court and establish custody.

I'll assume you are listed on the birth certificate as the father. That gives you equal rights to your son. In other words Joint legal custody. But I think you want to go for primary physical custody if the mother does not properly take care of your son. To do this you need to go to court and petition for it.
