    I received a default judgement on a debt and I had an attorney. He did not file a
    I filed bankruptcy in 2008. A creditor on my listed on my list of creditors sued me. A paralegal in the office of the attorney that filed my petition was recommended to negotiate on my behalf in the law suit. The paralegal did not file the necessary documents with the court and I received a default judgment. I just received a letter from,not the original attorney that filed the suit, but a new attorney asking for the debt. What are my options, if any at this point.

    During any bankruptcy proceeding if a lawsuit is filed against the person filing for bankruptcy the attorney's office is supposed to furnish the creditor with a copy of the bankruptcy number. The creditor should have also been notified if they were listed as one of your creditors.

    Basically, the paralegal messed up in not properly notifying the creditor of the pending bankruptcy proceedings.

    What does the bankruptcy attorney who the paralegal works for say about this? If anything he should be defending you against this judgment. It should not have technically happened. The paralegal hopefully has professional insurance and you can sue her for not properly handling this matter for you.

    If the paraleagal messed up then by all means the attorney she works for should straighten this mess out for you for free!
