Desire to terminate live in relationship
Currently, I am living with a man in a home (the only name on the lease is mine and he moved in at least one year after I first signed my contract). We were planning to marry but it has become increasingly obvious to me that this is NOT going to work. I have told him on several occasions that this is not working and he insists that he is not leaving. What legal steps should I take to ensure that I have all of my ducks in a row? He does not pay rent, in fact has only paid nominal amounts on any bills since he moved in. Should I give him a 30 notice to leave or what. Please help I am really tired?

Yeah, you sound tired, and I can see why. I've never understood people who insist on staying where they're not wanted. I'm not legally qualified, and it may vary by location, but I would start by talking to your landlord so he/she know the facts. Then give him a date certain to be gone, and if he doesn't leave by then, call the cops and charge him with trespass. Some guys just can't take a hint. If your landlord has a better idea, try that. He may have experience with getting rid of unwanted guests.

I don't think the landlord needs to be involved, but I would make a non emergency call to the police to get your facts straight about how to handle a trespasser. If it comes to the police hauling him off, I would recommend putting all his stuff in storage while he is detained and handing him the key to the storage unit once he returns. You'll have to pay for one month's storage rental but its worth the peace of mind since really ends it. Oh, and line up a locksmith to change the locks on your house too (and don't forget to give one to your landlord-- you can explain it all after the fact then).

I would agree this should be handled more like a case of trespass. By all means check with your local law enforcement to see what they say. But I would tell him he has x number of days (14-30) to move. Otherwise you will treat him as a trespasser and have him removed.

On the specified date, when he leaves the house, call a locksmith and have the locks changed. Take his suitcases and pack all his clothes. Place them in the garage or someplace outside the house, but secure. Tell him he can arrange a date to come by and pick up the rest of his belongings then make sure you have several friends there at the time.

You can pay to have his things moved to a storage facility if you want, but that might be more expensive.
