    Unmarried fathers rights
    I just had a baby the father is not on the birth certifcate nor paternity papers or nothing. He has an awful drinking problem , I also have had to make police reports on him while pregnant of him smashing my belly and pushing and choking me. He has been it trouble with the law in the past for drugs and domestics,had to take anger management and other reasons. He does hold a full time job and has an apartment. I have been letting him come to my house to see the baby , latly he has been threatening to take me to court to try to get baby . I have no problem letting him see the baby, but on his own is out of the question. He is not fit at all and Im afraid he'd get drunk and forget about the baby. I live in IL. Please help me with some answers of what rights he may actully be able to get through court after proving the baby to be his. By the way I have a full time job, a nice home, no history with the police except reckless driving over 5 years ago and speeding tickets.

    IF he files for custody/visitation the Judge will hear both sides of this story and make a decision in the best interest of the child. You will need PROOF that he is unfit or a danger to the child. I do not see him getting physical custody but, as the father, he is entitled to visitation and at some time when the child is older, overnight visitation.

    You need to ask for no visitation or supervised visitation.

    Was he like this when you got pregnant?

    Let him threaten all he wants. IF what you say is true and you can prove it, then he stands almost no chance of getting custody and will probably not get anything more than supervised visitation.

    No , well you see I had been friends with him for over 10 years , he keep asking me for a family after we got together. When I went to get birth control he got pissed said he really wanted a baby and family. Before I got pregnant we used to drink together him more than myself. When we first got together he would have done almost anything for me and had respect for me. But I don't know what happened but it became where he had no respect for me and started talking to me awful even when sober. Latly he's been said he's going to come see the baby then he don't show up nor notify me also he's missed DR.s appt's. O and thank you very much for your answer it helped thanks.
