    Georgia multiple tenants
    State is Georgia

    One roommate has not been paying rent. The lease says we are "joint and severally liable" although the landlord has been accepting checks individually. The other roommate hasn't paid for the last 7 months and the landlord hasn't evicted us yet. Are we going to be responsible for the rent?

    If the landlord decide to hold you responsible the terms of the lease allow it. However, if he tries to collect that fact that he has let you continue to pay just your share the fact that he has allowed you off the hook for so long may work against him.

    Why hasn't the landlord tried to evict her?

    I forgot to say the she never actually moved in with us, she moved to another state to work. Would this legally get her out of paying?

    Why have they not tried to find another person to rent in their place.

    The landlord can try to collect from all of you, it appears the terms of the lease would allow that. Again as Scott mentioned the fact he has never tired all these months would be a defense in court.

    Has the landlord mentioned something ?
