My daughter has a drug problem. My granddaughter father passed away in July, due to my daughter drug abuse my grand daughter's ssi check is being abused and my daughter is going absent for a month at a time. I filed for temporary emergency custody and on that date, I withdrew due to my daughter committing to a drug / alcohol abuse program and set a custody hearing on January 7. I did not know that this custody hearing would be not be a temporary custody hearing due to my daugther not fullfilling her obligations, My daughter on January 7, admitted to the courts not fullfilling her obligations but since my daughter wanted to continue and would not agree to temporary cusotday, the court set a hearing date on March 12, 2010. My daughter was gone from Jan 7 (evening) to Jan 12, (evening) she was home long enough to get the SSI check then she was gone again. I filed for another temporary hearing, explained everything that I was going through along with my granddaughter and the hearing was granted with a guidem eligtement assigend along with children services being called in. This occurred on Jan 21, 2010. I was denied emergency temporary custody due to Kaylee being take care of by me and her not being in eminent danger. I am not sure how to proceed. March 12, 2010 is not looking good for me I do not think the courts are heaing me and I do not have money for a lawyer. My daughter just returned home on Jan 29, after being gone two full weeks with the SSI check.

Have you asked the Court about free legal representation because you are representing the interests of your Granddaughter?
