    What can I do if I have been kicked out of an apartment with a lease?
    I got notice on Dec. 31 that I had to be out by Jan. 1. I live in Texas. I am on the lease and I pay my bills. I haven't done anything against the lease. My landlady says that I'm listed as temporary tenant but that's not what my lease says. My ex roommate won't give me access to get my belongings that I need for school even though she knew days ago. My ex roommate lied to the landlady about me as well.I don't know what to do about either.

    First you may try taking or having a police officer meet you at that address, it is not legal to change the lock and evict you without proper court hearings

    Then you sue them in court for the unlawful eviction

    It is law that they must give you 30 days written notice. And I agree qith chuck up there you take the police with you and you ex-roommate had no choice but to let you get your stuff (you may have to make a list of everything in there that is yours and the police will get it for you) but if your ex roommate still won't let you with the police there then it is called THEFT so... but look up Texas landlord and rental laws

    First you have to prove residency. Do you have ID showing the address as your residence? Do you have rent receipts or canceled checks showing you paid rent? Do you have a copy of the lease? How were you informed that you had to be out?

    Once you have assembled your proof of residence, you ask the police to accompany you to get your things. Once you have your things, you go to small claims court and sue the landlord for the lodging costs until you can find a new place as well as storage and moving costs. There is no way either the landlord or your roomie can kick you out with 1 day notice.
