    Standardized deduction for 2009
    Hello
    Want to wish you a " Happy New Year". It is time to start preparing for tax filing. I am an Indian citizen with income in the US, was on Optional Practical Training.

    The question I have is

    1). Can I claim standard deduction on the US-India Tax Treaty? If yes, what is the amount that can be used.

    Yes, because you are STILL considered to be a student while on OPT, and Indian students CAN claim the standard deduction under Article 21 of the U.S.-India Tax Treaty.

    For 2009, the standard deduction is $5,700.
