    How to respond to Wisconsin statute 802 for a business loan
    Our bank which we have a business loan has filed papers with our circuit court to get a judgement against us and after that the banker said they may rework the original loan but not until a judgement gets awarded. We have asked to get a lower monthly payment because our business has slowed due to ecomony. We have to reply according to chapter 802 of Wisconsin Statutes. What or how do I do that?

    Hello P:

    The only reason to file, according to statute such and such, would be if you want to fight the lawsuit, and you don't. If you want them to re-organize your loan, and the only way they'll do that is with a judgment in hand, then you don't want to oppose the petition. As a matter of fact, you want to hurry it along. I'd proceed with a motion for summary judgment. Yes, it's a motion the plaintiff usually files, but there ain't nothing holding you back from doing it.

    If, on the other hand, you DON'T want a judgment (you didn't say), then you need to hire a lawyer. You can't win by yourself, and we can't teach you here.
